Court OKs Family Dollar Stores gender bias settlement

A federal district court on Wednesday approved a $45 million class action settlement of a gender discrimination case filed by female store managers of Family Dollar Stores Inc.

According to the original complaint in the case, Luanna Scott et al. vs. Family Dollar Store Inc., which was filed in October 2008, female store managers were paid less than male store managers for performing the same jobs in violation of Title VII of the Civil Rights Act of 1964 and the Equal Pay Act.

The settlement, approved by the U.S. District Court in Asheville, North Carolina, creates a $45 million settlement fund that will be used to make individual settlement payments to female store managers who worked from July 2002 to November 2017, among other uses. Plaintiff attorneys will be awarded $15 million.

The settlement agreement states, “The Court has not decided whether Family Dollar did anything wrong, and Family Dollar contends that it has at all times treated all employees fairly with regard to salaries and other compensation regardless of sex.”

The joint motion seeking the settlement agreement states it “achieves a favorable result without the risks, costs and delay of additional sustained litigation, appeals and remands.”

A spokesman for Chesapeake, Virginia-based Dollar Tree Inc., which acquired Family Dollar Stores in 2014, could not immediately be reached for comment.
