Lawmakers in Oklahoma pre-filed a pair of bills Thursday making modifications to the state’s workers compensation law.
S.B. 369 would allow the surviving spouses of firefighters or police officers who died in the course and scope of employment to receive benefits from the state’s multiple injury trust fund for a full five years even if they remarry. Currently, remarriage of the spouse discontinues them from continuing to receive death benefits.
S.B. 324, would clarify the exclusive remedy provision of the state’s workers compensation law by adding language that an employer’s knowledge that an injury was substantially certain to result from its conduct will not constitute an intentional tort for the purposes of the application of exclusive remedy.
If signed into law, both pieces of legislation would take effect Nov. 1, 2021.
Oklahoma Insurance Commissioner Glen Mulready on Wednesday approved a 9.6% decrease in workers compensation insurance loss costs for 2021. Workers comp loss costs have decreased every year for the past decade, marking a 54% decrease in loss costs since 2011.
