Missouri lawmakers pass bill to limit punitive damages

The Missouri Senate and House on Tuesday approved a bill that would limit when punitive damages can be awarded.

Republican Gov. Mike Parsons is expected to sign the measure into law.

Senate Bill 591 provides that punitive damages will be awarded only if the plaintiff proves “by clear and convincing evidence that the defendant intentionally harmed the plaintiff without just cause or acted with a deliberate and flagrant disregard for the safety of others.”

Among its provisions, the bill states that initial pleadings in a civil action cannot include a claim for a punitive damage award.  It states also that when an employer admits liability for the actions of an agent in a claim for compensatory damages, the court must limit discovery to employment records and documents, or information related to the agent’s qualifications.

The bill is supported by the Missouri Chamber of Commerce and Industry. A spokesman for the governor did not respond to a request for comment.
