Dunkin’ Donuts consumers intolerant of extra charges

Lactose intolerant and other Dunkin’ Donuts customers with milk allergies think it’s time to sue the coffee chain over its practice of charging an additional $0.50 to $2.15 for substitute products such as almond or soy milk. 

A new class-action federal lawsuit is accusing Dunkin’ Donuts of discriminating against individuals seeking non-dairy additives in their coffee or tea, an act that plaintiffs say violates the federal Americans with Disabilities Act and other state anti-discrimination laws, according to the lawsuit filed in the Northern District of California.

The lawsuit alleges that Dunkin’ has “created a separate, higher-priced menu, aimed at customers who cannot ingest milk” and that “(n)o additional labor costs are associated with using a non-dairy alternative surcharge in a beverage. Additionally, the retail cost of non-dairy alternatives is not significantly more than dairy products.”
