Appellate court rules against Illinois restaurants in COVID cases

An Illinois state appeals court on Friday issued four rulings against numerous restaurants in the Chicago area that had sued Society Insurance Co. for COVID-19-related business interruption coverage.

The rulings by the Appellate Court of Illinois, first district, fifth division, which affirmed lower court rulings, all held that policies issued by Fond du Lac, Wisconsin-based Society Insurance did not provide coverage for losses caused by governmental COVID-19-related mitigation orders.

The lead or sole plaintiffs in the rulings were Black Rock Restaurants LLC, JCJ Restaurant Co., R. Restaurant Group LLC and Station Two LLC. On June 30, the same court had ruled in Society’s favor in a lawsuit filed by 14 Illinois taverns and restaurants.
