Genetic nondiscrimination rules ready

WASHINGTON—After a nearly 18-month wait, final regulations will be issued Tuesday under the Genetic Information Nondiscrimination Act.

The Equal Employment Opportunity Commission published proposed regulations under Title II of GINA on March 2, 2009, which was followed by a period of public comment. According to an advance copy of the regulation, after consideration of the public comments, the EEOC has revised portions of the final rule and the preamble.

Title II of GINA, which went into effect in November 2009, prohibits using genetic information in making employment decisions, restricts acquisition of genetic information by employers, and strictly limits its disclosure.

Observers have warned that employers should brace themselves for more lawsuits charging GINA violations.
