NY considers first responder presumption bills

New York lawmakers on Monday read through two bills that aim to provide disability benefits on presumption for first responders who suffer from lung disease or heart disease.

Both S.B. 8558 and S.B. 8557 would apply to correction officers, correction supervisors, deputy sheriff patrols and deputy sheriff patrol supervisors.

Both bills state that the diseases “shall be presumptive evidence that such disability was incurred in the performance and discharge of duty and the natural and proximate result of an accident, unless the contrary be proved by competent evidence; provided, however, that prior to entry into service, such correction officer, correction supervisor, deputy sheriff patrol or deputy sheriff patrol supervisor successfully passed a physical examination which failed to disclose evidence of any disease or other impairment” of the heart or lungs.

Both bills were referred to the Civil Service and Pensions committee.
