Bills on post-accident drug testing, vacation pay


A measure introduced ahead of the legislative session starting Wednesday would require that Virginia employers conduct post-accident drug testing.

H.B. 153 would state that for the purposes of determining the cause of a workplace accident, employers shall require post-accident drug testing for the use of nonprescribed controlled substances for “any employee whose conduct could have contributed to the accident.”

The bill would also prohibit insurers from offering a drug-free workplace premium discount to any employer that does not implement policies to comply with the drug-testing requirement.

Also in the works is a resolution introduced in the House of Delegates that would require a study on the effect of disallowing charging premiums based on bonus pay, vacations and holidays.

House Joint Resolution 11 would direct the Virginia Workers’ Compensation Commission to study a prohibition on charging comp premiums on bonus pay, vacations and holidays.

The requested study would have to consider the amounts of such premiums, the effect that a prohibition would have and “whether the objectives of the Workers’ Compensation Act would best be served by forgoing or prohibiting the charging of workers’ compensation premiums on bonus pay, vacation time or holiday time.”
