Material Girl’s lawyers say no material injury in late-start concerts

Some concerts start two hours late, and Madonna thinks that’s OK.

Madonna, who is being sued alongside concert promoter Live Nation for starting her New York concert late, forcing concertgoers to scramble with late-night transportation and a morning after complicated by too little sleep, is asking a federal judge to dismiss the proposed class action. 

As plaintiffs justified their claims in part by arguing that they “had to get up early to go to work” the next day, Madonna’s lawyers are now arguing that that’s hardly the kind of legal “injury” that can result in a lawsuit, according to Billboard magazine.

“Plaintiffs speculate that ticketholders who left the venue after 1 a.m. might have had trouble getting a ride home or might have needed to wake up early the next day for work,” wrote Madonna’s lawyers. “That is not a cognizable injury.”

The lawsuit, filed in January and one month after the concert, claimed Madonna and Live Nation breached contracts and violated state laws on false advertising and unfair business practices.
