Sportswear maker Wooter on Tuesday sued Dick’s Sporting Goods over similarities between its logo and that of Dick's women’s clothing brand Calia, according to Reuters.

Wooter said in its trademark lawsuit filed Tuesday in federal court in New York that the Calia logo is virtually identical to its infinity symbol branding and likely to cause customer confusion.

According to the complaint, Dick’s considers Calia to be one of its “powerhouse vertical brands” as stated in an Investor presentation in August. The sporting goods chain also claimed that Calia is now the second largest women’s apparel brand, behind Nike.

Representatives for Dick's did not immediately respond to a request for comment Wednesday, according to Reuters.

The U.S. Patent and Trademark Office said in response to Dick’s federal trademark application that its logo could cause confusion with Wooter’s.

Wooter attorney Robert Garson told Reuters that the PTO's response should have been recognized as “a shot across the bow” to Dick’s.
