Judge upholds Biden rule on ESG considerations in retirement plans

A Texas federal judge on Sept. 21 dismissed a lawsuit from 25 states aiming to obstruct a Biden administration rule permitting employee retirement plans to factor in environmental, social, and governance (ESG) considerations during investment decisions, Reuters reports. U.S. District Judge Matthew Kacsmaryk affirmed that the rule, effective from Jan. 30, mandates that financial factors remain primary, and doesn't show inherent regulatory preference for ESG-focused strategies.
