Court rejects Aviva’s motion to dismiss class action over BI losses

The Ontario Superior Court of Justice has rejected insurer Aviva Canada Inc.’s motion to dismiss a class action lawsuit filed by Canada-based window and door manufacturer Nordik Windows Inc. over COVID-19-related business interruption losses, Canadian Underwriter reported. Nordik and its sister company Cash and Carry Inc. filed a claim in May 2020 for business interruption losses as a result of COVID-19, however, Aviva denied coverage in June 2020.
