Judge clears path for provider to sue Cigna for unpaid COVID testing claims

A Connecticut medical provider accusing Cigna Health & Life Insurance Co. of failing to cover more than $6 million in COVID-19 testing costs can sue the insurer under ERISA but not pandemic-specific federal legislation, a federal judge ruled, reports Bloomberg Law. Neither the Families First Coronavirus Response Act nor the Coronavirus Aid, Relief and Economic Security Act authorize private parties to file a lawsuit claiming violations of the statutes, Judge Janet Bond Arterton of the U.S. District Court for the District of Connecticut held March 11.
