Biden administration sued over COVID mandate for contractors

A nonpartisan civil rights group has sued the Biden administration over its mandate that federal contract workers get vaccinated against COVID-19 or be tested weekly.

The Washington D.C.-based New Civil Liberties Alliance filed the class-action lawsuit Monday in U.S. District Court for the Western District of Michigan in Grand Rapids on behalf of 11 federal contract workers. The suit, Case 1:22-cv-00005, accuses a number of defendants — President Joe Biden, the Safer Federal Workforce Task Force, the Office of Management and Budget, and other government agencies and officials — of requiring workers to take a vaccine without their consent.

According to a statement issued by the organization, the vaccine is being required for “those with naturally acquired immunity, against the medical advice of experts — thereby depriving them of their constitutional right to bodily integrity and to refuse unwanted medical care and violating their statutory right to informed consent.”

Two subclasses are being sought within the class-action suit, one for naturally immune contractor employees and one for remote workers. The plaintiffs are seeking judicial relief from what they called “the unlawful and unconstitutional” mandate.

The latest suit comes on the heels of more than a dozen states and organizations filing legal motions against the administration’s vaccine mandates — some of which have been stayed in the courts — and on the eve of the U.S. Supreme Court’s consideration of a mandate requiring vaccinations or weekly testing of workers at companies with more than 100 employees.
