Lawsuit gives strawberry Pop-Tarts the raspberry

Kellogg Co.’s strawberry whole-grain frosted Pop-Tarts contain more dried pears than they do dried strawberries, says a putative class-action lawsuit filed against the company.

The lawsuit — Elizabeth Russert et al. v. Kellogg Sales Co. — filed Tuesday in U.S. District Court in White Plains, New York, states that the 16th, 17th and 18th ingredients listed in order of predominance by weight on the product’s package are dried pears, dried apples and dried strawberries, respectively.

The pastry’s name is “false, deceptive and misleading,” says the lawsuit, which seeks injunctive relief, monetary damages and attorneys costs.

Kellogg said in a statement it does not comment on pending litigation.
