N.Y. bill would remove exclusive remedy for sexual offenses

A New York bill would remove the exclusive remedy of the workers compensation act for workers who were injured as a result of a sexual offense.

S.B. 4672, introduced Monday, would modify existing statutes to enable an employee suffering from an injury from a workplace sexual offense to pursue any remedy available for compensation for damages resulting from the injury if the sexual offense was due to negligent acts or omissions by the employer.

The bill would entitle workers comp insurers providing benefits to a lien on any damages awarded.

If signed into law, it would take effect immediately.
