A judge in Florida has stricken a lawsuit filed by three residents in Jacksonville, Florida, over a local perfume factory’s “vile” odors, Florida’s First Coast News reported Wednesday.

The fight behind the lawsuit, filed Jan. 6 against International Flavors and Fragrances and tossed this week, will likely continue, the news outlet reported. The local fragrance factory is facing allegations that its “noxious” emissions are destroying their quality of life.

The judge in the ruling “rejected the language of the filing for technical reasons, but not substantive ones.”

“That’s, I think, a very promising sign that the judge doesn’t dispute that these are the right people to bring this kind of a case before a judge,” Josh Gellers, a board member with the Murray Hill Preservation Association, which is tasked with handling the situation and working with the city, told a reporter.
