Michigan governor reinstates COVID-19 rebuttable presumption

Michigan Gov. Gretchen Whitmer issued an emergency rule on Friday reinstating a rebuttable presumption for first responders and health care workers in the state who contract COVID-19.
On June 17, the governor issued an executive order to presume that health care workers and first responders who contract COVID-19 did so in the workplace unless the employer can prove otherwise.
However, the Michigan Supreme Court on Oct. 2 struck down the executive order, along with others, in a 4-3 decision, holding that the governor did not have the authority to issue emergency orders.
Gov. Whitmer’s new issuance of the emergency rule was necessary to protect public health, her office said in a statement.
The emergency rule took effect immediately and will be effective through March 20, 2021.
