Nevada governor signs workplace protection, liability limit law

Nevada Gov. Steve Sisolak on Tuesday signed into law a bill that would limit liability of employers who follow COVID-19 protocols and create additional worker protections in the state. The bill passed both the state’s Assembly and Senate on Aug. 5 with votes of 31-10 and 16-5, respectively.

S.B. 4 requires the Nevada Department of Health and Human Services to establish minimum cleaning standards for public accommodations in Las Vegas and several other areas of the state. The bill also directs the department to adopt regulatory requirements for facilities of public accommodation in certain counties to reduce and prevent the transmission of COVID-19 and enforce such regulations. The legislation also authorizes the Nevada Gaming Control Board to require casinos under its domain to submit written copies of its COVID-19 prevention protocols. 

The legislation also provides immunity to certain businesses, governmental entities and not profits from civil liability for personal injury or death resulting from exposure to COVID-19 if the business has “substantially complied with controlling health standards” and is retroactive to March 12, 2020, expiring on July 1, 2023.
