Verisk 3D restraining order made permanent

A federal court has converted into a permanent injunction a temporary restraining order that forbids Verisk Analytics Inc., which lost an associated patent case in September, from selling certain technology related to 3D models of aerial roof repairs.

The U.S. District Court in Camden, New Jersey, issued the permanent injunction against Jersey, City, New Jersey-based Verisk and its Lehi, Utah-based Xactware Solutions Inc. unit on Friday, in the latest legal development between Bothell, Washington-based Eagle View Technologies and Verisk.

The order gives Verisk seven days to deliver a copy of the injunction to customers that have ordered or purchased the “infringing product.”

In September, a jury of the court awarded $125 million to Eagle View, which had charged Verisk and affiliate Pictometry International Corp. with violating seven patents, according to the 2015 complaint in the case, Eagle View Technologies Inc. et al. v. Xactware Solutions, Inc. et al. The complaint in the case was filed in 2015.

“The Court’s order allows us to connect with new, returning and existing customers whom we are excited to support,” said Rishi Daga, CEO of Eagle View, in a statement.

“We are pleased that the Court safeguarded our innovative technologies and halted the Defendants’ illegal activities that sought to undermine our business for years,” the statement added.

Verisk said in a statement it “is disappointed with the outcome of this case and is exploring all available legal options.”
