Rochester, New York-based Wegmans Food Markets Inc. is accused of not putting vanilla in its vanilla ice cream, according to a class-action lawsuit filed in federal court on Friday.

As reported by Buffalo, New York’s WKBW station, which accessed the complaint, two customers allege that “The front label statements of ‘vanilla ice cream’ are understood by consumers to identify a product where the characterizing flavor is vanilla and supplied to the products only from the vanilla plant.”

The suit claims that Wegman’s store brand vanilla ice cream actually contains “flavors derived from non-vanilla sources, which is misleading to consumers,” according to the suit.

The spokesperson for Wegmans issued a statement saying that the company takes “great pride in the quality of all of our Wegmans Brand products. We believe that the labeling of our ice cream fully complies with all regulations and industry standards, and is not misleading in any way."
