TGI Friday’s likely won’t have much to be thankful for regarding a New Jersey appeals court decision Thursday that granted class certification in a lawsuit filed by a man who didn’t know his beer was going to cost more than $5.
Specifically, sole plaintiff Robert Cameron filed suit over a meal he ordered at a TGI Friday’s in Toms River, New Jersey. When he saw the bill, he was shocked to see the price of his beer and that a soda cost $3. He claimed he would not have ordered the drinks if the prices had been listed, according to the New Jersey Law Journal.
Thursday’s 2-1 ruling comes nearly two years after the New Jersey Supreme Court rejected class certification in a previous class suit over the same allegations: the lack of prices on the drink menu at several establishments.
The difference in the two cases is that the present case seeks only monetary damages on behalf of class representative Mr. Cameron. Legal experts weighing on the old case, which named five establishments, sought damages for an entire class, an award that could have topped $1 billion, according to the news outlet.
