Trucking firm having a cow over right-of-way collision

A trucking company is suing a Texas man, alleging his roaming cow collided with one of its trucks.  

According to the Wichita Falls Times Record News, Winco Trucking LLC of Lufkin, Texas, filed a lawsuit Wednesday against Ryan Looper of Holliday, Texas, alleging he failed to take care of his livestock, but let his cows meander onto U.S. Highway 82.

The complaint, filed in the 89th District Court in Wichita Falls, Texas, alleges that the heifer butted heads with a Ford F-150 pickup driven by one of Winco’s employees on Sept. 20, 2018. The company claims that Mr. Looper “knowingly permitted” his cow to roam on the right-of-way of a highway and contends that this negligence “foreseeably and proximately caused” damages to the company’s truck. However, the complaint doesn’t state why the driver was unable to avoid the cow, what portion of the highway or county the driver was in at the time of the crash, or mention the current condition of the cow.

The lawsuit seeks to recover $38,000, attributed by the company as the lost value of the F-150, as well as prejudgment interest, interest after judgment and court and attorney fees.
