NLRB pilot enhances alternative dispute resolution program

The National Labor Relations Board on Tuesday said it is launching a pilot program to enhance use of its alternative dispute resolution program.

The agency said the voluntary pilot program will increase “participation opportunities” for parties to the ADR program and “help to facilitate mutually satisfactory settlements.

The NLRB said that under the program the board’s office of the executive secretary will “proactively engage” parties with cases pending before the board to determine whether the cases are appropriate for inclusion in the program.

The agency said the ADR program “can provide parties with more creative, flexible and customized settlements of their disputes.” It said parties may withdraw from participation at any time.

Experts say the NLRB’s return to pre-Obama era handbook rules restores a better balance between employer and employee rights and is a welcome relief to employers.
