Never mind, where’s the beef. McDonald’s customers suing the fast-food chain want to know where’s the discount if they forgo the cheese on their quarter-pounder?

Lawyers for McDonald’s this month filed a motion to dismiss the lawsuit, filed in May in federal court in Florida, that claims customers are unfairly charged for cheese they do not want on their burger, Inc. magazine reported Sunday.

The 32-page lawsuit alleges McDonald’s is pocketing the 30 to 90 cents it saves by not including the cheese but charging full price, according to the article.

Meanwhile, McDonald's is claiming the suit is "nonsense" when it suggests that "retail restaurants have some legal obligation to reduce the price of a standard menu item to reflect the customer's decision to decline some ingredient or component of that item," according to the article.

That claim "not only has no basis in law," the McDonald's lawyers wrote in their motion to dismiss, "but would create utter chaos in the retail food industry" if it were allowed to proceed, Inc. reported.
