New York seeks public comments on drug formulary

The New York State Workers Compensation Board is seeking public comments on a proposed drug formulary that limits new opioid prescription to seven days for injured workers.

The regulations propose that refills for opioids be subject to prior authorization in line with formularies in states such as California and Texas.

The New York board launched its 60-day public comments period Dec. 27, 2017, with a Feb. 26, 2018, deadline.

Governor Andrew Cuomo signed into law in April 2017 legislation that required the board to establish a “comprehensive” drug formulary. The proposed formulary is set to go into effect July 1, 2018, the board stated in its announcement.

“However, the drug formulary and regulations will not become effective until the regulations are adopted and a final implementation date has been determined,” a statement read.
