Shippers could be liable for cargo damage despite Act of God defense: Official

Dick Lucarelli, vice president, sales and marketing, at U.S.-based freight claims firm CDS, said that shippers could be liable for cargo damaged by natural disasters despite using the Act of God defense, Global Trade reported. "This defense can only be used when there was nothing that the carrier could have reasonably done to prevent the damage," said Mr. Lucarelli. The Act of God defense states that carriers are not liable for cargo damage caused by a natural disaster beyond their control.
