Patties stacked in the battle of the burgers

Double take: In-N-Out Burgers is suing rival Smashburger over its “triple double burger,” which it says customers could confuse with In-N-Out’s signature “double double.” 

The Irvine, California-based burger chain filed its trademark infringement lawsuit Monday, citing brand confusion among the reasons, Los Angeles’s KABC reported. 

Denver-based Smashburger IP Holder L.L.C. was founded in 2007 and launched its stacked-burger creation in July as part of its 10-year anniversary. Meanwhile, the double double has been a staple at In-N-Out since 1963, the station reported. In-N-Out also sells a triple triple, on the menu since 1966.
