California workers comp system receives half of required lien supplement forms

About half of the supplemental lien declaration forms related to lien claims filed in California’s workers compensation system between 2013 and 2016 have been filed with the Division of Workers Compensation, according to a statement Monday by the California Department of Industrial Relations.

The 441,070 supplemental lien declaration forms that have been filed represent about half of the 882,648 liens filed in California’s workers comp system between 2013 and 2016 for which a filing fee was paid. Lien claimants who don’t file the “supplemental lien form and 4903.05(c) declaration” form liens will be dismissed, the department said in the statement. 

Senate Bill 1160 requires all lien claimants who filed a lien between Jan. 1, 2013, and Dec. 31, 2016, and paid a filing fee to file a supplemental lien declaration form. The state’s labor code was amended to address fraud in the workers comp system, according to the statement.
