Battle of the bras hits fashletics industry

The popular Canadian athletic-wear company Lululemon is suing Baltimore-based Under Armour over bra straps, according to media reports. 

Lululemon claims Under Armour, which markets similarly snazzy pants, shorts, shirts and sports bras for runners and yogis alike, is specifically infringing on Lululemon’s copyright on a sports bra with parallel, interweaving straps, according to media reports on the suit that was filed on Friday in a Delaware federal court. 

Lululemon claims its Energy bra is recognizable as a Lululemon bra to frequently purchasing consumers in the sports bra market, according to the Fashion Network, which pointed out that Lululemon sells its model for $52; Under Armour's Eclipse sells its similar product for $40.

Accessed by multiple media outlets, Lululemon's filing states: “The infringing products are so similar in design to the trade dress that they are likely to cause confusion, mistake, and deception as to the source of origin of the infringing goods among consumers.”
