Ace USA confirmed Tuesday that it will exclude coverage for Ebola claims under new and renewal general liability polices issued to companies that have exposures to certain African countries.

Ace is “selectively using a policy endorsement to exclude Ebola on a case-by-case basis for insureds that have foreign travel exposure to certain African countries with potentially higher risk exposure,” the insurer said in a statement. “The endorsement is being applied during the underwriting process only on new and renewal policies based on information about each company's travel to and operations in select territories.”

The endorsement excludes coverage for any “injury, damage, expense, cost, loss” or liability related to the Ebola virus, according to a copy of the exclusion obtained by Business Insurance.

It also expressly excludes coverage for:

•Manufacture, sale, distribution or administration of any vaccine or medication intended to prevent or treat Ebola;

•Any failure to provide Ebola vaccines or treatment, including those caused by delays in development or lack of availability;

•Any complications arising out of medical treatment of Ebola patients, and any aggravation of another disease or medical condition caused by concurrent treatment for Ebola; and

•Any failure to adequately warn, quarantine, sanitize or take other measures to prevent or mitigate the effects of Ebola.

The endorsement excludes both defense and indemnity coverage.
