Sex club shooting case goes to jury for workers comp fraud decision

SACRAMENTO—A jury is deliberating the workers compensation felony fraud case against a correctional guard and his wife who claimed his shooting outside a San Francisco sex club was work-related.

Prosecutors from the Sacramento District Attorney’s office allege that John Alfonzo Smiley and his wife, Cynthia Ann Biasi-Smiley, lied when they claimed that Mr. Smiley was shot while leaving a restaurant in 2008 by a parolee who recognized him as a prison guard.

Instead, investigators allege he was shot outside a swingers club after Mr. Smiley had sex with the shooter’s companion.

Prosecutors also allege the couple lied to collect workers compensation benefits. The shooting left Mr. Smiley paralyzed from the waist down.

According to a spokeswoman for the Sacramento County Superior Court, the jury received the case on Wednesday and continued deliberating on Thursday.
