Pharmaceutical sales reps and overtime

The U.S. Supreme Court will weigh in on the issue of whether pharmaceutical sales representatives are exempt from being paid overtime. The court has agreed to review the 9th U.S. Circuit Court of Appeal's February, 2011 ruling in Christopher v. SmithKline Beecham, in which it held they are exempt under the Fair Labor Standards Act. That decision conflicts with the 2nd U.S. Circuit of Appeal's July, 2010 ruling in In re Novartis Wage & Hour Litigation, which held the reps are not exempt.
