Supreme Court refuses to hear illegal immigrant comp case

WASHINGTON—The U.S. Supreme Court has declined to hear a case in which a Louisiana employer sought to argue that federal law prohibits paying state-mandated workers compensation benefits to an illegal immigrant.

At issue in the case of Vaughan Roofing & Sheet Metal L.L.C. vs. Antonio Garcia Rodriguez was whether the Immigration Reform and Control Act of 1986 trumps state laws that require employers to provide workers comp benefits to injured workers.

The case the court on Monday declined to hear involved a roofer injured in 2004 when he fell from a roof, court records state. Louisiana’s 3rd Circuit Court of Appeals ruled that three parties, including Vaughan Roofing, were liable for providing benefits.
