Baldwin seeks dismissal of ‘Rust’ shooting suit citing exclusive remedy

Counsel for Alec Baldwin and other “Rust” film producers on Monday filed an argument for dismissal of a civil lawsuit filed by a script supervisor who was on the set when the actor allegedly fatally shot a cinematographer.

According to court documents filed in the Los Angeles Superior Court, the defendants’ attorneys cited workers comp exclusive remedy as cause for dismissal, arguing the case be thrown out over lack of evidence Baldwin or any of the producers intended harm.

Mamie Mitchell filed the civil suit in November, claiming Mr. Baldwin was at fault for not checking that the Colt .45 revolver was not loaded with live ammunition.

Cinematographer Halyna Hutchins was killed and director Joel Souza was wounded when the gun discharged as Baldwin was rehearsing on the New Mexico film set.

Ms. Mitchell alleges assault, intentional infliction of emotional distress and deliberate infliction of harm, despite having suffered “no apparent physical injury,” documents state.
