The Equal Employment Opportunity Commission has accused a staffing company of retaliating against a worker who filed a discrimination charge.

The agency said Tuesday that Duluth, Ga.-based staffing and professional recruiting firm Hire Dynamics L.L.C. had assigned an unidentified employee to one of its clients as a quality auditor.

After the employee was suspended for a week for missing one day of work, he filed a discrimination charge against the company. In its lawsuit against the company, the EEOC charges that in retaliation, he never was given any further job assignments or opportunities.

The EEOC accuses the company of violating Title VII of the Civil Rights Act of 1964.

“When an employee files a discrimination charge with the EEOC, an employer has no right to punish him for exercising his rights,” EEOC District Director Bernice Williams Kimbrough said in a statement. “In today's employment climate, the importance of protecting workers who utilize the charge filing process is greater than ever.”

A company spokesman could not immediately be reached for comment.

Retaliation charges filed with the EEOCincreased during fiscal 2012 continued to increase, even as the total charges declined.
