Cases linger at Texas workers comp agency: Audit

July 16, 2010 - 2:03pm

AUSTIN, Texas—A state audit report details shortcomings at a Texas agency charged with overseeing discipline of medical providers and insurers failing to comply with workers compensation laws.

The Texas Division of Workers' Compensation “should correct weaknesses in its enforcement process,” concluded the Texas state auditor's report released Thursday.

Problems include a backlog of unresolved cases. As of April, 661 pending enforcement cases were open an average of 467 days, according to the report. One case remained open since 2006 and 58 were open since 2007.

A log used to monitor cases was incomplete and supervision of staff was lacking while chain-of-command problems existed, the audit found.

Release of the audit followed news reports that several former division workers complained about delays in enforcement against physicians suspected of abusing the system.

A spokesman for the division said Friday that improvements already were being made.
