Judge goes light on powerlifting deputy out on comp

A San Diego County Sheriff’s Deputy was sentenced Tuesday to three years of probation instead of the maximum of five years in prison after investigators secretly recorded him lifting weights at the gym while he was supposedly recovering from a work injury, according to The San Diego Union-Tribune.
“Dumbbells weighing 80 pounds in each hand. Leg presses of 600 pounds. Deadlifts of 315 pounds from floor to hips,” documented a reporter in California, quipping, “Impressive for a man out on workers compensation for a back injury reportedly caused by lifting two five-gallon water bottles.”
Deputy Matthew Tobolsky, a six-year officer with the force, was arrested in 2017 on 14 counts of insurance fraud and related charges, according to the article. He stood accused of defrauding the state workers compensation system, causing $57,000 in losses, $46,000 in cash paid directly to him, the newspaper reported.
While video surveillance of his workout was key in his conviction, no video exists nor did anyone see Deputy Tobolsky lift two water bottles, the newspaper reported.
