Judge says give me a break on Kit Kat lawsuit

A federal judge has thrown out a class-action lawsuit against The Hershey Co. that claimed customers expecting white chocolate in white Kit Kats are being misled, ruling that the case holds no water over the packaging that claims the candy is “white” and does not refer to chocolate, Legal Newsline reporter Tuesday.
The judge in New York’s Eastern District relied on the Merriam-Webster dictionary to point out white is “the color of new snow or milk,” according to the article.
“There is no dispute that the Kit Kat White is, as the modifying adjective suggests, white in color,” the judge wrote in a decision on Monday.
Plaintiffs lawyers had argued that customers were “misled because the products are placed next to chocolate bars in store displays,” according to the article.
