Sept. 30 deadline set to submit pay data to EEOC

A federal court said Thursday that the U.S. Employment Opportunity Commission should set a Sept. 30 deadline for employers to submit EEO-1 data on employees’ pay and hours worked for 2018.

Employers are to provide the data through an online system, according to the EEOC.

U.S. District Judge Tanya S. Chutkan in the District of Columbia said in her ruling in National Women’s Law Center et al. v. Office of Management and Budget et al. that the EEOC by Monday must issue a statement on its website and submit to the Federal Register a notice that EEO-1 filers should prepare to submit the data no later than Sept. 30.

A spokeswoman for the EEOC had no comment, while spokesmen for the National Law Center and the OMB could not immediately be reached for comment.

According to reports, the Trump administration in 2017 announced a “review and immediate stay” of the EEO-1 pay data collection rule, which was an Obama-era rule issued that required companies with 100 or more employees to confidentially report to the EEOC information about what they pay their employees by job category, sex, race and ethnicity.

According to the EEOC website, EEO-1 report will provide summary pay data that will encompass more than 63 million workers “and will strengthen enforcement efforts of pay equality laws and help employers evaluate their own practices.”
